SYRACUSE, NY.–According to ESPN, a United States district judge in New York declared on Wednesday that former NASCAR driver Tony Stewart is not protected from claims of wrongful death by waivers that Kevin Ward, Jr. had signed. Ward was the driver who was killed in a track accident in which the long-time Columbus resident was involved. Judge David Hurd decided the lawsuit could proceed and to let a jury determine whether Stewart should be held liable for Ward’s death in 2014. A grand jury has already decreed that Stewart did not commit a criminal act.
